2) Registration and Conditions for Making the Purchase 

In order to purchase the Products, the Client must first proceed with the Registration. The Registration consists of two phases: first phase: insertion by the Customer of name, surname, email address, password, telephone, consent to the processing of personal data pursuant to the Privacy Legislation and the Privacy Policy of Tao Technologies, acceptance of the General Conditions; Phase II: entry by the Client of profession and address and any data for invoicing.  Tao Technologies hereby declines all responsibility for the unauthorized processing of the password chosen by the Customer. The Client undertakes to keep the Access Credentials secret with the utmost care and diligence. In the event of theft and/or loss of the Credentials, the Customer must immediately notify Tao Technologies in writing in order to allow their timely deactivation and replacement, by contacting the address info@taopatch.com. It is forbidden for the Client to transfer, for any reason, the Access Credentials to third parties or in any case to allow third parties to access the Online Courses or the purchase of Devices. The registered Customer can also access the contents of the Site; some content is reserved for Professionals only. 

3) Price of Products 

The price of each Product is indicated on the Site and the reference for determining the same is on the date on which the Order was sent. Prices, as indicated, are inclusive of VAT. On the other hand, transport costs and VAT are not included, the amount of which is, however, specified at the time of sending the Order and at checkout. The amount of transport costs may vary depending on the weight, volume and destination of the Products purchased.  The Customer must take care to update his/her personal data by inserting any changes that may have occurred in order to ensure that they are always correct and up-to-date. 

4) Orders 

Customer Registration is a prerequisite for placing an Order.  The Customer can place the Order through the Site. Tao Technologies also accepts any Orders placed by telephone, video call or email, subject to Customer Registration, acceptance of the General Terms and Conditions and authorization to process data.  Once the Registration has been made, the Customer can proceed to choose the Products on the Site, selecting them and placing them in the virtual "shopping cart".  Once the selection of the Products to be purchased has been made, the Customer must indicate the chosen payment method among those possible (as indicated in the "Payment methods" section) as well as any data necessary for invoicing (tax code and/or VAT number).   Orders from persons under the age of 18 will not be accepted. Consumer Customers may only purchase the "Buy and Try" Device. Professional Customers can purchase the Devices only upon successful participation and successful completion of the Course called "Taopatch Basic Module". 

5) Payment Methods Devices and other items 

Payment of the price of the Devices may only be made in the following ways:  a) Credit card: Visa, Mastercard, Cartasì, Poste pay and all circuits accepted by the PayPal payment system. In this case, payment is charged to the Customer at the time of the Order.  b) Cash on delivery: payment is made in cash to the person in charge of delivery in any case in compliance with the limits set by law for payment in cash. Cash on delivery payment can also be made by bank or cashier's check made out to Tao Technologies or on different instructions provided by Tao Technologies in the Order confirmation. In the event that the payment by cheque exceeds the amount of € 1,000.00, the non-transferability clause must be indicated in addition to the name of the beneficiary. Payment by cash on delivery may result in the Client being charged the management fees for this payment method.  c) Bank transfer: Payment must be made by the Customer to the bank details provided by the company Tao Technologies in the Order Confirmation. In this case, the goods will be shipped only after verification by the company Tao Technologies of receipt of payment. In case of non-payment of the ordered goods within 15 working days, Tao Technologies will be free to cancel the Order received or to change the payment method, sending the goods to the Customer with cash on delivery (see point 5/b). Face-to-face courses The Registration Fee for face-to-face Courses can only be paid in the following ways: a) Credit card: Visa, Mastercard, Cartasì, Poste pay and all circuits accepted by the PayPal payment system. In this case, payment is charged to the Customer at the time of the Order. b) Bank Transfer: Payment must be made by the Customer to the bank details provided by Tao Technologies in the Order confirmation. In this case, Course Enrollment is determined by receipt of payment by Tao Technologies. In case of non-payment within 15 working days or by the start date of the Course, Tao Technologies will be free to cancel the Order received and to preclude the Customer from accessing the training event. On-Line Courses The Enrolment Fee for the Online Courses can only be paid in the following ways: a) Credit card: Visa, Mastercard, Cartasì, Poste Pay, and PayPal. In this case, payment is charged to the Customer at the time of the Order. b) Bank Transfer: Payment must be made by the Customer to the bank details provided by Tao Technologies in the Order Confirmation. In this case, the On-Line Course will be activated only after verification by Tao Technologies of receipt of payment. In case of non-payment within 15 working days or by the start date of the Course, Tao Technologies will be free to cancel the Order received and to preclude the Customer from accessing the training event. 

6) Confirmation and acceptance 

Order Devices & Other Items Upon placing the Order, the Client will receive, at the email address indicated, an email confirming receipt of the Order, summarizing the type and quantity of the Products chosen, the price of the same, taxes, means of payment, shipping costs, identification data and billing data entered by the Customer. If, within 24 hours of receipt of the aforementioned email, no notification of modification is received from the Customer, Tao Technologies will proceed to check the availability of the Products and send the Order Confirmation email. In the event that, for any reason, Tao Technologies is unable to process the Order, Tao Technologies will promptly notify the Customer. On-Line Courses Upon placing an Order on the Academy Platform and paying the Registration Fee by credit card, Tao Technologies sends, within 24/48 hours of payment, Confirmation of Course Activation. From that moment on, the Course can be used by the Customer. Upon placing an Order on the Academy Platform and choosing to pay the Registration Fee by Bank Transfer, Tao Technologies will send the Course Activation Confirmation within 24/48 hours of receipt of payment. From that moment on, the Course can be used by the Customer. Tao Technologies reserves the right to modify, replace or cancel the contents of the Courses at any time, or not to follow up on the delivery of the Course by notifying the Customer, to change the structure of the Platform, dates, duration, speakers, as well as the methods of delivery of all or individual Courses.  Face-to-face courses Upon placing the Order, the Client will receive, at the email address indicated, an email confirming receipt of the Order, summarizing the type and quantity of the Courses chosen, the price of the same, the identification data and the billing data entered by the Client. If, within 24 hours of receipt of the aforementioned email, no communication of modification is received from the Customer, Tao Technologies will proceed to check the availability of the Courses and send the Order Confirmation. In the event that, for any reason, Tao Technologies is unable to process the Order, Tao Technologies will promptly notify the Customer. °°° Tao Technologies reserves the right to refuse the Order in the following cases: indication of untrue personal data; failure to provide a tax code and/or VAT number; Orders from individuals under the age of 18; Orders from Consumers concerning Products other than "Buy and Try"; existence of previous non-compliance with Tao Technologies; subjection of the Client to insolvency proceedings; registration of the Client in the list of complaints; lack of the requirement of participation and successful passing of the Taopatch basic module for the purchase of Products where they are a condition of purchase. 

7) Shipping and delivery of products 

Devices & Other Items The Products purchased will be delivered exclusively to the domicile or residence indicated by the Client in the Registration or Order. The shipment is made in a single solution, at the same time as the availability in the warehouse of all the chosen Products. In the event that Tao Technologies does not have one or more of the Products ordered in stock, it will ship only the available Products, subsequently integrating the supply with the shipment of those missing.  Tao Technologies makes shipments by courier of its trust, chosen from among leading companies in the sector.  Tao Technologies undertakes to deliver the selected Products within 7 working days, where the delivery is to be made in Italy, San Marino or the Vatican City. For deliveries to be made abroad, delivery will be made within 30 working days. The time limit starts from: - date of sending the acceptance of the Order in the case of payment by credit card or cash on delivery; - date of receipt of the consideration in the case of payment by bank transfer. On-Line Courses Upon receipt of the Registration Fee and within 24/48 hours of the same, Tao Technologies will send the Client the confirmation of Enrolment of the Course from which the Course can be used by the Client. In any case, participation in the Course will not be allowed without payment of the Registration Fee. Face-to-face courses Upon receipt of the Registration Fee and within 24/48 hours of the same, Tao Technologies will send the Client the confirmation of Enrolment in the Course from which the Course is available to the Client. Access to the Course is precluded in the absence of payment of the Registration Fee. 

8) Right of withdrawal 

Devices & Other Items The Professional may freely exercise the right of withdrawal within 14 working days from receipt of the Devices (or in the case of multiple shipments from receipt of the last Product) by means of communication to be made by registered mail to Tao Technologies. In this case, Tao Technologies will notify the Customer by email of receipt of the notice of withdrawal. From the date of notification of the exercise of the right of withdrawal, the Customer must provide for the physical return of the Products within the following 14 working days. The return of the Products and the full refund of the amount paid can only take place in the event that the Products are intact and unused.  The shipping costs for the return of the goods remain at the expense of the Customer. Therefore, returns made by the Customer by shipping with charge to the recipient will not be accepted. The risk of any loss or damage to the goods in the course of transport lies with the Customer until the time of delivery of the Products to the Customer.  In the event that the returned Products prove to be damaged or used, or the Products are returned after the indicated deadline or not adequately packaged, Tao Technologies reserves the right to deduct the amount of the damages suffered from the refund due to the Customer.  The refund is made by Tao Technologies within 30 days from the notice of withdrawal by crediting the amount to the bank details indicated by the Customer (or possibly with other payment methods previously agreed between the parties). A credit note is also issued. Buy&Try Devices The Consumer may freely exercise the right of withdrawal within 14 working days from receipt of the Devices (or, in the case of multiple shipments, from receipt of the last Product) by means of communication to be made by registered mail to Tao Technologies Srls, also using the standard form sent together with the delivery of the Devices. Face-to-face courses The Professional may freely exercise the right of withdrawal within 14 working days from the formulation of the Order and in any case before participation in the Course if the period of time between the confirmation of Registration and the start of the Course is less than 14 days. Online Courses The Professional may freely exercise the right of withdrawal within 14 working days from the formulation of the Order and in any case before participation in the Course if the period of time between the confirmation of Registration and the start of the Course is less than 14 days. 

9) Expiry of Products / Warranty 

Devices & Other Items 

The statutory warranty on the Products may vary depending on the type of Product. Taopatch Devices have a 2-year warranty. On-Line Courses The User has the right to choose between the methods of use of the Course in concrete associated with each training event offered for sale by Tao Technologies Srls through the Academy Platform.  Face-to-face courses If the Client is unable to participate in the Course for which he/she has requested his/her Enrolment, Tao Technologies Srls will retain the deposit paid by the Client for the Enrolment; in this case, if the Client has notified Tao Technologies Srls of the impossibility of participating in the Course with at least 48 hours notice before the start date of the Course, he/she may use this deposit for participation in a subsequent Course or for the purchase of one or more Products; this right must be exercised by the Client within 12 months, after which the deposit will be definitively withheld by Tao Technologies and the Customer will be forfeited from the aforementioned right. 

10) Replacement of damaged products

 If the Products purchased are defective or damaged during transport, the Customer may request their replacement from Tao Technologies, within 8 days of receipt, by sending an email describing the types of defect or damage found documented with photos. Tao Technologies reserves the right to replace the defective or damaged Product with another of the same type or to reimburse the Customer, upon return of the defective or damaged Product. 

11) Rules on the use of the material covered by the Courses 

 By registering on the Site or accessing the authorizations deriving from participation in the Courses, the Client can view confidential material. This material may include: technical explanations, opinions and testimonials, instrumental tests, clinical/university data and research, video content, graphics, texts, images, photos. Tao Technologies is the exclusive owner of the copyright (Law 22.04.1941 n. 633) and of any right of economic use on the aforementioned material; It is therefore prohibited, either in whole or in part, to copy, communicate, disseminate, publish, extrapolate through any means (press, websites, blogs, social networks, radio, TV, etc.), any form of reproduction and in general any economic exploitation by subjects other than Tao Technologies.  This is without prejudice to Tao Technologies' right to authorize any of the aforementioned conduct in writing. The same prohibition applies to the dissemination and/or reproduction, both total and partial, of the topics covered in the courses organized by Tao Technologies, of the names and data of those present and/or participants. Anyone who, without right, for any purpose and in any form, engages in any of the aforementioned conducts is subject to the penalties provided for by art. 171 et seq. of Law no. 633 of 22.04.1941 and/or civil actions for damages. 

12) Rules on participation in the Courses: 

The Participant assumes responsibility for his/her own statements and undertakes to comply with these clauses. Tao Technologies is not responsible for the statements of its Customers. Tao Technologies is not responsible for conducting courses similar to the Courses or organized by third parties or courses organized by Professionals for the purpose of better teaching its patients/customers how to manage the Devices in their possession. The Student must: – behave in such a way as to allow all the Trainees present, Tao Technologies and the speakers chosen by it to carry out the Course correctly . – respect the privacy of those present; – give space to the questions of the other students; – avoid creating disturbance with ringtones, phone calls, electronic devices, background buzz and any other behavior that prevents or limits the quality of the use of the contents by other Students. In the event of repeated behaviour that disturbs other Trainees, the lecturers or the dining room staff may ask the Trainee to leave the room dedicated to the course and to re-enter only after concluding the disturbing behaviour (e.g. phone calls, ringtones or the use of audio/video recording devices, taking photos and/or the use of Google Glass or similar devices that disturb privacy and/or that are not desired in the classroom by any of those present in respect of their privacy).  In any case, the Student may not reproduce or distribute the contents of the Courses or part of them acquired through electronic devices.  In the event that the Trainee does not comply with the points listed above, he/she may be removed from the classroom without completing the course and may exercise the right to request the return of the amount paid, returning the material provided by him/her at the same time as the request by Tao Technologies. The Student agrees that Tao Technologies or professionals appointed by it to make audio and video recordings for the purpose of creating training material, review and in-depth analysis, advertising or dissemination, improvements to the training method and authorizes Tao Technologies to use this material for the purposes  indicated above. In the event that the Trainee does not wish to appear or be recognized in this context, he/she may send a written communication by registered mail with acknowledgement of receipt specifying this. In the event that a public video is processed, it will be the responsibility of Tao Technologies Srls to process the video using the appropriate tools for coverage, shading, etc., to avoid recognizability of the Trainee. If the course is organized with the release of CME credits, the relevant conditions  also apply according to current legislation. The purpose of the Courses is exclusively educational.  At the location of the Courses, during their in-person or remote performance, the Trainee is not authorized to advertise products, promote commercial relationships or professional collaborations, negotiate and/or conclude business with other professionals, customers, suppliers of Tao Technologies and/or with subjects who in any capacity participate in the Course or are present and may not collect and/or use the personal and contact data of other participants or subjects of which he/she becomes aware during the training event. The same prohibition also extends to all groups such as Telegram chats and/or social communities created by Tao Technologies. Violation of this prohibition will result in the cancellation of the Participant from all the aforementioned groups, communities, newsletters, the impossibility of subscribing to further Courses, the impossibility of applying the Taopatch method, and the impossibility of accessing any Product and Service provided by Tao Technologies, which reserves the right to ask the Customer for compensation for the damage caused by such conduct. "Taopatch Basic Module" course. To verify the correct understanding of the method and the topics, the student is subjected to a final exam at the end of the course itself or on another agreed date;  upon passing the exam, the student receives a certificate of participation in the course itself. In the event that the exam is not passed, the Student can re-attend the next course of the same type free of charge and repeat the exam. You can also request the support of a tutor to review the topics learned and take the exam again . In order to receive the certificate of qualification for the use of technology and methodology, the Trainee must also deliver after the above course, no.  10 "Taopatch® First Visit and Control Forms" which are duly delivered to the Trainee during participation in the course itself, or which the Trainee can download through the download area by accessing their Account on the Site, to attest to the actual practice carried out with Taopatch® technology. The Trainee can have the 10 duly completed forms delivered, on paper by sending them to Tao Technologies Via Trento 3/F int. 3 31030 Castello di Godego (TV) or by scanning them and sending them by email to the address: customercare@taopatch.com, to certify the actual practice carried out with Taopatch® technology.   In the event of malfunction, suspension and/or interruption of the Course on the Academy Platform for technical reasons, the Client must promptly notify Tao Technologies no later than 48 hours from the occurrence of the interruption event by e-mail, indicating the title of the Course and its name in the subject of the communication. 

13) Limitation of Liability  

On-Line Courses
Tao Technologies shall not be held liable for damages, of any kind, that the Client may suffer due to participation or non-participation in the Course, which depend on delays, suspensions, interruptions of the Course, defects and/or malfunctions of the Platform, total and/or partial, temporary and/or definitive, resulting from any cause not attributable to Tao Technologies, including, but not limited to: malfunctions of the Platform caused, in general, by: (i) wilful or negligent conduct on the part of the User, including failure to update software or non-acceptance of pop-ups necessary for the proper functioning of the Platform (ii) failures and/or malfunctions of equipment, systems and/or systems, of any type by the User or in use by the User; suspension and/or interruption of the internet connection service by the operator; network and/or server failures due to unforeseeable circumstances or force majeure; possible non-recognition of training credits for courses accredited by Professional Associations. Without prejudice to the above, it is understood that, without prejudice to the mandatory limits of the law for cases of wilful misconduct and gross negligence, the liability of Tao Technologies is limited to the maximum amount actually paid by the User for the purchase of the Course. 

14) Terms of Use of Web  Pages

The use of the Academy Platform is also subject to the Terms of Use published on the Footer of the same web page. The use of E-Commerce is also subject to the Terms of Use published on the footer of the same web page. 

15) Choice of Law and Jurisdiction  

 The Agreement between Tao Technologies and the Customer is governed by Italian law. For any dispute relating to the interpretation, conclusion, execution, resolution and in any case for all disputes relating to the Contract between Tao Technologies and the Professional, the Court of Padua shall have exclusive jurisdiction. For any dispute relating to the interpretation, conclusion, execution, resolution and in any case for all disputes relating to the sales contract between Tao Technologies and the Consumer, the Court of the consumer's domicile shall have jurisdiction.
